Taxation Reform and the Not-for-Profit Sector



McMillan Shakespeare is very aware of the serious concern of many Not-for-Profit (NFP) Health/Aged Care and Charity institutions that removal of the sector’s FBT concession may be a recommendation of the ‘Australia's Future Tax System Review’ (‘The Henry Review’).

To help provide a properly informed response from senior personnel and directors in the NFP sector to any such recommendation, we commissioned the attached report, ‘The case for retaining the FBT concession for NFP (Hospitals/Aged Care) and Public Benevolent Institutions in Australia’. The report has been prepared by Dr Nicholas Gruen, CEO of Lateral Economics. Dr Gruen is a noted Australian economist with an impressive record of achievement. His experience includes periods as an economic policy advisor to Federal Government Ministers and as an Associate Commissioner to the Productivity Commission.

As you will read in the report, he commenced this project by warning that he expected to find that removing the FBT concession was justified. The opposite has proved to be the case.

The report’s purpose is to assist both those in and external to the NFP sector, to understand the key arguments and issues for retaining the current FBT concessions. The report provides a powerful and logical series of economic arguments that seriously question some of the theories and propositions expected to be presented in ‘The Henry Review’ and published in the Productivity Commission’s research report ‘Contribution of the Not-for-Profit Sector’ January 2010.
